WAIVER and RELEASE FROM LIABILITY: In consideration of accepting this registration of the tennis program, I hereby agree to release and forever discharge, Eric Jordan, and any of its staff from any injury or damage from which may be sustained in any vary arising out of participation in the tennis program/event, or being driven or shuttled to and from the courts. I hereby for myself and my heirs, executors and administrators, waive and release any and all claims for damages I may have against Eric Jordan, its staff, their respective agents and sponsors, for any and all injuries suffered during my participation in this program.  As a condition of my participation in the program, I hereby grant Eric Jordan the right in perpetuity, for the purpose of the promotion and/or the advertising of the program or any events in which I participate, to use names, photographs, likeness, biographies, voices, other identifications, in print, film, radio, television, internet, and or any and all other media now known and hereafter devised and in all other publicity and promotional materials and media, including the right to use and/or sublicense such right to use the same on event posters, programs, merchandise and other materials. Eric Jordan shall have the right in perpetuity, without additional compensation payable to me, to make, use, show, and/or license for any and all purposes, in a commercial and/or non- commercial manner, still pictures, and motion pictures/recordings taken of me during the program or otherwise in any and all media known or hereafter devised, included without limitation, print, film, radio, television and the internet. Furthermore, I will be responsible for any and all damages caused by myself. I further represent that I am in good physical condition to participate in this program/event. *
COVID-19 ASSUMPTION OF RISK AND WAIVER OF LIABILITY: The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Eric Jordan has put in place preventative measures to reduce the spread of COVID-19; however, Eric Jordan cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, taking lessons and attending events at Eric Jordan location could increase your risk and your child(ren)’s risk of contracting COVID-19. By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I and my child(ren) may be exposed to or infected by COVID-19 by taking lessons and attending events at Eric Jordan location and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Eric Jordan may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Eric Jordan  employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself and/or my child(ren), including, but not limited to, personal injury, disability, and death, illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with or attendance at Eric Jordan or participation in Eric Jordan program and events (“Claims”). On my behalf and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Eric Jordan, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Eric Jordan, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Eric Jordan program and events. *
