1. Assumption of Risks. By signing this agreement, I acknowledge and understand that driving, operating, and riding a motorcycle (“motorcycle activity”) is hazardous, and may result in serious injury or death. I further acknowledge and understand that motorcycle activity has inherent risks (including death, loss of limb and permanent disability, and damage to or loss of property). I voluntarily choose to participate in the VFW Riders 8731 motorcycle ride (“Ride”), and assume the inherent risk associated with motorcycle activity.

2. Duly Licensed and Competent. I certify that I am duly licensed and competent to operate a motorcycle in a safe manner, and the motorcycle I will be operating during the Ride is in safe and legal operating condition. I am solely responsible for determining the speed and operational characteristics of my motorcycle, and for my actions as a motorcycle operator during the Ride.

3. No Physical or Mental Impairment. I certify that I have no known physical or mental impairment that may affect my safety or the safety of those participating in the Ride.

4. Promise Not to Sue. I hereby covenant in exchange for participating in the Ride, as a motorcycle operator or motorcycle passenger, that I will not sue or otherwise make any claims against VFW National Headquarters, VFW Department of Minnesota, VFW 6th District (MN), VFW Post 8731, VFW Riders 8731 (“VFW”) its officers, members, employees, and agents for any loss of damage that I may sustain during the Ride, including property damage or loss, personal injury, illness, and permanent disability and/or death.

5. Release of Liability. I hereby release, waive, discharge, and hold harmless the VFW and its officers, members, employees, and agents against any and all claims, causes of action, or any other liability of any kind arising from my participation in the Ride or actions during the Ride.

6. Promise to Indemnify. I agree to indemnify, defend and hold harmless the VFW officers, members, employees, and agents from and against any and all damages, claims, liabilities, demands, causes of action, judgments, settlements, losses, costs or expenses (including attorneys’ fees or medical expenses) arising out of any personal injury, illness, death, property damage, or loss to anyone else which occurs as a direct or indirect result of my activities during the Ride, or my actions or failure to act while participating in the Ride.

7. Compliance with Tour Requirements and Applicable Laws. I agree to abide by all Ride requirements and applicable laws regarding motorcycle activity or any other activity contained herein and agree that any violation of these requirements may result in termination of my participation in the Ride without recourse or refund. I understand that, subsequent to state and local regulations, the choice of wearing a helmet or other protective gear is solely my own and that the VFW Riders 8731 strongly recommends its Tour participants to wear protective gear.

8. Photo Policy. I agree and consent to the use and publication by the VFW of any photographs of me taken during the Ride.

9. Communications. By providing your name, mailing address, and/or email address you agree to accept communications from the VFW informing you of VFWR events at the National, regional, or local levels for which we believe you may be interested. You expressly agree to receive these occasional communications.

10. Governing Law. The validity, construction and effect of this agreement shall be governed and determined by and in accordance with the laws of the State of Minnesota. I agree that the State of Minnesota shall have exclusive jurisdiction over any dispute that arises from this agreement.

By signing this agreement, I acknowledge that I am waiving any claim(s) for myself or minor child, as permitted under state law.

I acknowledge and agree that the purpose of this agreement is to be as broad and inclusive as permitted by law and that if any portion is held invalid, that the remaining provisions shall remain in full force and effort.

I hereby agree to expressly and voluntarily accept and assume all risks involved in operating a motorcycle or participating as a motorcycle passenger during the Ride with the VFW.

The undersigned has read and voluntarily signs this VFW Riders 8731 Release and Waiver of Liability, Assumption of Risks and Indemnity Agreement.
